FMCSA Clearinghouse: Queries, Reporting, and Fleet Compliance Obligations
The FMCSA Drug and Alcohol Clearinghouse is a federal database that tracks CDL driver drug and alcohol violations. Every motor carrier is legally required to query it—and most carriers are still missing queries they should have run.
What Is the FMCSA Clearinghouse?
The FMCSA Clearinghouse (also called the Drug and Alcohol Clearinghouse, or just "the Clearinghouse") is a secure federal database maintained by the Federal Motor Carrier Safety Administration. It records:
- Verified positive drug test results for CDL drivers
- Verified positive breath alcohol tests (0.04 or higher)
- Refusals to test
- Actual knowledge violations
- Return-to-duty (RTD) completions
Motor carriers must query the Clearinghouse before hiring a CDL driver and annually for all current CDL drivers.
Full vs. Limited Queries
FMCSA supports two query types:
Full query: Returns all violations in the Clearinghouse for a specific driver. Requires written consent from the driver. Required annually for all current CDL drivers.
Limited query: Returns only whether violations exist (not the details). Does not require written consent. Used for pre-hire screening before full consent is obtained.
Most carriers should use limited queries for initial screening, then request written consent and run a full query before hire.
What Happens When a Query Returns a Violation?
If the Clearinghouse returns a violation:
- The driver cannot be hired or cannot operate a CMV in a safety-sensitive function
- The violation must be resolved through the RTD process (SAP evaluation, compliance, follow-up testing)
- Once RTD is complete, the motor carrier must report the clearance back to the Clearinghouse
Failing to report an RTD clearance keeps the driver flagged—and keeps the carrier non-compliant.
Common Compliance Failures
Missed pre-hire queries: A motor carrier hires a CDL driver without running a Clearinghouse query. If that driver had an unresolved violation, the carrier is liable.
Missed annual queries: FMCSA requires annual queries for all CDL drivers. Many carriers let this slip, especially when managing large fleets without automated systems.
Failing to report RTD clearances: After a driver completes RTD, the carrier or TPA must report the outcome to the Clearinghouse. Many carriers do this manually—and forget.
